These General Conditions of Sale are established between:

SA NeroGiardini France (Trade name of SA Alric Shoes Invest, owner of the website www.nerogiardini.fr , whose registered office is located at Avenue Montjoie 108/16, 1180 Uccle (Belgium). BE: 0447.975.593. Telephone: +32 (0)4 365.26.43. E-mail: info@nerogiardini.fr . Hereinafter referred to as “NeroGiardini”.

And natural or legal persons wishing to place an order via the NeroGiardini website ( www.nerogiardini.fr and/or its aliases) hereinafter referred to as “the Customer”.

1 Definitions

We will subsequently designate:

  • “Site”: the site and all of its pages;
  • “Products”: all the products (material) and services (intangible) that can be purchased or subscribed to on the site;
  • “User”: The Internet user visiting and using the site;
  • “Basket”: The intangible object grouping together all the goods or services selected by customers of the site with a view to a purchase by having clicked on these objects;

2 Object

2.1 Scope of application

These General Conditions of Sale apply, without restriction or reservation, to all relations between NeroGiardini and the Customer in the context of the sale of the items offered, the online publication and the ordering of the services offered on the website.

The applicable General Conditions of Sale are those in force on the date of the order by the Customer. The customer is deemed to have acknowledged them, to have accepted all the clauses and to waive the right to invoke these conditions of purchase.

NeroGiardini reserves the right to modify its General Conditions of Sale at any time.

The General Conditions of Sale are permanently available on our website and will prevail, where applicable, over any other version or any other contradictory document, unless prior, express and written derogation from NeroGiardini .

Any cases of application not provided for herein shall be governed by the practices in force in the internet sales sector for Belgian companies.

2.2 Acceptance

Confirmation of the order by the Customer on the NeroGiardini website constitutes full acceptance and adherence to the General Conditions of Sale.

Unless proven otherwise, the data recorded by NeroGiardini constitutes proof of all transactions.

2.3 Interpretation

The headings of the articles in these General Conditions of Sale are provided for information purposes only and may not under any circumstances be used as a pretext for any interpretation or distortion of the clauses to which they relate.

2.4 Duration

The duration of application of the General Conditions of Sale corresponds to the duration of the online publication of the articles and services offered by NeroGiardini .

3 Articles and Services

3.1 Validity

The items offered on the website www.nerogiardini.fr are valid while stocks last. Information on the availability of items is provided directly online at the time of placing the order. However, this information is provided for information purposes only and may vary from actual stock levels .

3.2 Knowledge of the article

The Customer is solely responsible for the choice of items and services, and their suitability for his or her needs, such that NeroGiardini cannot be held liable in this regard. The Customer will also have taken care to know the essential characteristics of the items and services offered on the website in order to place his or her order with full knowledge of the facts.

3.3 Geographic area

Orders placed with NeroGiardini are deemed deliverable in Europe, unless otherwise expressly provided by NeroGiardini subject to specific conditions regarding deadlines and payments, which will be defined in an amendment to the order.

4 Order

4.1 Ordering procedure

The Customer is responsible for selecting the items he wishes to order on the site, by adding them to his shopping cart.

The order must then be confirmed by the Customer when the latter makes the actual payment.

4.2 Validation of the order

The sale will only be considered final after NeroGiardini has sent the Customer confirmation of acceptance of the order, indicating that the payment made by the Customer has been accepted.

Acceptance of the order is therefore conditional upon full payment by the Customer before delivery.

For any suspicion of fraud on an order, NeroGiardini reserves the right to refuse the sale and refund the amount paid.

4.3 Order tracking

The Customer can follow the progress of his order at any time on the NeroGiardini website in his personal space.

5 Rates

5.1 Purchase price

The items are supplied and delivered at the rates in effect on the day NeroGiardini confirms acceptance of the order and as communicated to the Customer prior to placing the order.

The price indicated in the order confirmation by NeroGiardini is the final price. Prices are expressed in Euros, including all taxes and excise duties. They do not include any delivery charges, which are detailed in the "Delivery Charges" section.

5.2 Price modification

NeroGiardini reserves the right to modify its prices at any time. In this case, the applicable rates will be those in effect at the time of the Customer's order.

Any increase in VAT or any new tax that may be imposed between the time of the order and the time of delivery will be the responsibility of the customer.

6 Payment Conditions

6.1 Payment deadline

The price is payable in cash, in full on the day the order is placed by the Customer. NeroGiardini will not be required to deliver the items ordered by the Customer if the price has not been previously paid in full (price including tax and any delivery costs).

6.2 Payment methods

6.2.1 General

Banking information (card number, expiry date, cryptogram) is never in our possession since banking transactions are processed directly and in a completely secure manner by our payment partners.

Whatever the method of payment for the order chosen by the Customer, it will only be considered final after actual collection of the sums due to NeroGiardini .

Collection is considered final in the following cases:

  • Bank transfer: the full amount of the order appears on NeroGiardini account statements.
  • Debit or credit card payment: The full order amount is approved by Shopify Payments.
  • PayPal: The full order amount is approved by the PayPal payment processor.

NeroGiardini reserves the right to cancel any order whose payment origin appears fraudulent.

6.2.2 Procedure

Regarding the secure payment system, NeroGiardini uses the services of Shopify Payments or PayPal, payment solutions designed for e-commerce. As soon as you complete the payment, the website directs you to the Shopify Payments or PayPal platform depending on your payment choice. Shopify Payments/PayPal collects the necessary information and processes the payment request. After verifying the payment, Shopify Payments/PayPal redirects you to the NeroGiardini website. 6.2.3 Liability

NeroGiardini declines all responsibility in the event of payment errors or any transactional problems related to the Shopify and PayPal payment interfaces as well as erroneous bank transfers.

6.3 Preparation of the order

The order is prepared when NeroGiardini has received the full payment and all the elements necessary for the proper execution of the contract, namely: the complete contact details of the Customer and the recipient of the order. As long as these conditions are not established, the order is not prepared and, in this case, no delay in delivery can be opposed to NeroGiardini .

6.3.1 Exception

When the order, and consequently the payment, shows signs of bank fraud, NeroGiardini is free to suspend or cancel the order entirely and report it to the Federal Crime Computer Unit.

7 Delivery

7.1 Delivery costs

7.1.1 Delivery in Belgium

NeroGiardini offers a single delivery package including transport costs which amounts to 6 Euros including VAT via Bpost and 4 Euros via Mondal Relay for the whole of Belgium and applies to the entire order, regardless of the number of products ordered.

For any order equal to or greater than 100 Euros including VAT delivered in one go to an address located in Belgium, delivery will be free of charge.

7.1.2 Delivery in Europe (excluding Belgium)

For Luxembourg, NeroGiardini offers a single delivery package including transport costs which amounts to 4 Euros via Mondial Relay and applies to the entire order, regardless of the number of products ordered.

For France and the Netherlands,  NeroGiardini offers a single delivery package including transport costs which amounts to 5 Euros via Mondial Relay and applies to the entire order, regardless of the number of products ordered.

For any order equal to or greater than 100 Euros including VAT delivered in one go to an address located in Luxembourg, France or the Netherlands, delivery will be free of charge.

For Spain and Portugal , NeroGiardini offers a single delivery package including transport costs of 8 Euros via Mondial Relay and applies to the entire order, regardless of the number of products ordered.

For Germany NeroGiardini offers a single delivery package including transport costs of 10 Euros via Mondial Relay and applies to the entire order, regardless of the number of products ordered.

For any order equal to or greater than 150 Euros including VAT delivered in one go to an address located in Spain, Portugal or Germany, delivery will be free of charge.

For Austria and Italy, NeroGiardini offers a single delivery package including transport costs of 5 Euros via Mondial Relay and applies to the entire order, regardless of the number of products ordered.

For any order equal to or greater than 150 Euros including VAT delivered in one go to an address located in Austria or Italy, delivery will be free of charge.

7.1.3 Other countries

NeroGiardini has the right to apply a specific delivery charge to the order depending on the countries not specified in Articles 7. For this type of delivery, the Customer must send an email to info@nerogiardini.fr before confirming his order to know exactly the applicable delivery charges.

7.2 Time limit

Items purchased by the Customer will be shipped within 1 to 5 business days from the time the order is placed, provided that payment has been made and confirmed.

The items ordered will be delivered to the address indicated by the Customer when ordering on the NeroGiardini website.

7.3 Exceeding the deadline

If the delivery deadline is exceeded by more than 7 days from the date of dispatch, not justified by a case of force majeure, the Customer must inform NeroGiardini by registered mail within 15 days. The Customer must indicate whether he wishes to obtain a refund of the sums paid for the sale, excluding any other compensation or damages. After the 15-day period, NeroGiardini will consider that the items have been delivered and the Customer will no longer be able to make any complaints to NeroGiardini for non-receipt of his order.

7.4 Packaging

Except in exceptional circumstances, items are delivered in the original supplier packaging.

7.5 Transport

7.5.1 BPOST (Home Delivery)

The package is delivered the next business day after delivery by the postman if the delivery address is in Belgium. Outside Belgium, the delivery time may vary from 2 to 7 days following delivery by the postman.

Each package has a unique barcode. With the Track & Trace app, you can track your package's whereabouts online.

If the Customer is absent when the package is presented, he/she can request a second presentation by telephone or come and collect the package within 14 days from the post office or Post Point.

7.5.2 Mondial Relay (Collection point)

The package is available on average 3 to 5 working days after dispatch to the Mondial Relay collection point chosen by the customer when ordering.

7.5.3 Local Delivery

For people living in the Liège region, home delivery by us is free.


By selecting “Local Delivery” when confirming your order, your order will be delivered to your home within 3 business days. We will inform you of our delivery date and time by email.

7.5.4 Free In-Store Pickup

You can also pick up your order free of charge from one of our stores.

By selecting “Pick up in store” when confirming your order, you can pick up your order during store opening hours. Your order will be delivered to you upon presentation of an ID and the confirmation email showing your order number.

7.6 Compliance

The Customer is required to check the condition and conformity of the delivered items upon delivery.

It is his responsibility to make all necessary observations in the event of a defect or missing items within 3 days of receiving the package by sending an email to the following address: info@nerogiardini.fr .

In the event of a lack of conformity, NeroGiardini will assume the return costs and replace the item as soon as possible and at their expense. If the replacement of the item is not possible, the Customer may either return the item and have the price refunded, or keep the item and have part of the price refunded in the form of a voucher on the website www.nerogiardini.fr .

7.6.1 Accuracy of delivery data

Delivery address: If all or part of the delivery address turns out to be incorrect, forcing NeroGiardini to return the order, it is the Customer's responsibility to bear all the consequences (delay in delivery, additional delivery costs, etc.).

NeroGiardini cannot be held responsible for the impossibility of delivering the goods in the event of an error on the part of the Customer.

7.6.2 Delay in delivery

NeroGiardini cannot be held responsible for a delay in delivery beyond its control such as a strike by the transport provider or force majeure.

8 Right of withdrawal

8.1 Time limit

In accordance with Article 47 § 1 of the Belgian law of 6 April 2010 on market practices and consumer protection, the consumer has a withdrawal period of 14 calendar days from the day after the day of delivery to return purchased items that do not suit him. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or email). To meet the withdrawal period, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

You must return or hand over the goods without undue delay and, in any event, not later than fourteen days after you have communicated your decision to withdraw from this contract to us. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period.

You are only liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

8.2 Return Procedure

At NeroGiardini , the customer has 14 days from the date of dispatch of the items to return the items (with the exception of sale items), subject to compliance with the conditions set out in the paragraphs below. This 14-day right of return does not limit legal rights and guarantees. Any return must first be notified to NeroGiardini Customer Service by email at info@nerogiardini.fr , mentioning the reference of your order and the item you wish to return. NeroGiardini will confirm that the return has been notified and will detail the return procedure to follow. Return costs are the responsibility of the Customer. We recommend that you request the return within 7 days of receiving your order to ensure that it reaches the store within 14 days.

Only items returned in their entirety, in their original packaging, complete and intact, showing no signs of wear indicating that they have not been worn and in perfect condition for resale will be accepted. Upon receipt of the package, NeroGiardini will assess the perfect condition of the returned merchandise. Any item that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged. In the case of an exchange, if the returned items have been visibly used or damaged by the customer and this use or damage makes them unfit for sale, NeroGiardini may take all corresponding recovery actions from the customer.

If the customer's order includes multiple items and they wish to return more than one item, they must select all the items they wish to exchange or be refunded during the return request.

If the customer wishes to return items from different orders, they must separate the items into separate packages when returning them. Any return of items from different orders that do not meet this condition cannot be processed within the timeframes set out in our General Terms and Conditions.

8.3 Exercise of the right:

In the event of exercising the right of withdrawal, the consumer has the choice of requesting either a refund of the sums paid or an exchange of the item. In the case of an exchange, reshipping will be at the expense of NeroGiardini . One exchange per item is authorized.

In the event of a refund request, NeroGiardini undertakes to reimburse the sums paid by the consumer within thirty days.

8.4 Reimbursement Method:

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you expressly agree otherwise; in any event, this reimbursement will not incur any fees for you. The reimbursement will be made by one of the cancellation procedures below:

8.4.1 Mastercard/Visa: Reimbursement will be made primarily by canceling the payment via our Shopify payment interface.

8.4.2 Paypal: The refund will be made primarily to the user's Paypal account.

8.4.3 Others: Under all other conditions and regardless of the payment method used for the order, the user will be reimbursed by bank transfer.

NeroGiardini will not issue any cash refunds for returned items purchased with a gift card. The corresponding card will be automatically credited with the corresponding amount by the relevant partner.

In the event of receipt of a returned package whose contents do not comply with the return request or whose items do not comply with the return conditions mentioned above, NeroGiardini reserves the right to exercise all corresponding recovery actions against the customer.

9 Intellectual Property

All elements of the NeroGiardini website, namely texts, comments, illustrations, images and sounds, are, except for public documents and additional details, the exclusive property of NeroGiardini . They are protected as such by copyright.

Any representation, reproduction, distribution and redistribution, in whole or in part, of the elements of the NeroGiardini website other than for private, non-commercial or educational purposes, is strictly prohibited and constitutes an infringement, except with the express prior authorization of NeroGiardini . This authorization may be withdrawn at any time.

Any person wishing to place on their site a simple link or a hyperlink directly to the home page of the NeroGiardini website may only do so with the prior written authorization of NeroGiardini . This authorization may be withdrawn at any time. NeroGiardini declines all responsibility for the content of sites linked to the NeroGiardini website.

10 Responsibility

10.1 Limitation

NeroGiardini strives to ensure, to the best of its ability, the accuracy and updating of the information on the website, the content of which it reserves the right to correct at any time and without notice.

NeroGiardini declines all responsibility for any imprecision, inaccuracy or omission concerning information available on the site; for any damage resulting from fraudulent intrusion by a third party resulting in a modification of the information made available on the site; and more generally for any damage, direct or indirect, whatever the causes, origins, nature or consequences, caused by anyone's access to the website or the impossibility of accessing it, as well as the use of the website and/or the credit given to any information coming directly or indirectly from the latter.

The photographs reproducing the articles are not contractual and are published for information purposes only.

10.2 Accessibility of the site

The website is accessible 24 hours a day, 7 days a week, except in cases of force majeure, IT difficulties, difficulties related to the structure of communication networks or technical difficulties. For maintenance reasons, NeroGiardini may interrupt the site at any time.

10.3 Quality

NeroGiardini is committed to providing quality products. NeroGiardini assumes no liability for any defects in the product.

11 Protection of privacy

In accordance with the Belgian law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, it is recalled that the personal data requested from the Customer are necessary for the processing of his order and are intended for internal use by NeroGiardini . The communication of this data may be decided by NeroGiardini , under legal conditions, to meet legal and regulatory obligations. This information will under no circumstances be disclosed to third parties or resold.

The Customer has the right to access, modify, rectify and oppose information concerning him/her, under the conditions provided for by the law and regulations in force and which are specified in the sections “General Conditions of Sale” and “Privacy” accessible on the website.

In accordance with Article 8 of the Belgian law of 11 March 2003 on certain legal aspects of information society services, NeroGiardini ensures the conservation of the written record of the customer's order for a period of ten years from the date of delivery of the items that were the subject of said order and guarantees access to it at any time during this same period.

12 Applicable law, competent courts and language of the contract

By express agreement between NeroGiardini and the Client, the website and all acts resulting from it – including these General Conditions of Sale – are governed by Belgian law.

The Customer and NeroGiardini will do everything to amicably resolve any conflicts that may arise from the application of these General Conditions of Sale by calling NeroGiardini Customer Service, which is authorized to take all necessary measures to resolve these conflicts.

In the event of disputes, the Courts and Tribunals of the district of LIEGE (Belgium) shall have sole jurisdiction.

NeroGiardini's contractual relations with the client are governed by Belgian law.

The language of the procedure is French.
